Terms and conditions

These terms and conditions govern the contract concerning the sale of products offered on the website www.assaggiatori.com between the Centro Studi Assaggiatori Soc. Coop. (hereinafter “Taster Study Centre”) with registered office in Galleria Vittorio Veneto 9, 25128 Brescia, Italy, Tax code/VAT ID no. 03116250170 and the Customer (hereinafter “Customer”).
The purchasing of products and online services implies complete acceptance, without exception, of these general sales terms and conditions. The General Terms and Conditions shall remain valid and effective until they are amended and/or integrated by the Taster Study Centre. Any amendments and/or integrations of the General Terms and Conditions shall be effective from the date on which they are published on the Site and shall apply to the sales carried out with effect from the aforementioned date, any exceptions to these general conditions are indicated when purchasing the individual products.. The latest updated version of the General Terms and Conditions is the one available in the specific section of the website.

 

1 – Scope of Application

The Site provides an online product sales service. The products that cannot be purchased are out of stock until they become newly available. An out-of-stock product cannot be retrieved. The Taster Study Centre can accept the Customer’s orders within the limits of the quantities of existing products requested but cannot accept orders from Customers located in countries or sites that are extremely difficult to reach when processing orders or due to tax issues. Therefore, the acceptance by the Taster Study Centre of the purchasing proposal forwarded by the Customer is subject to the availability of these products and of the other obligations expressed. The Taster Study Centre is committed to promptly informing the Customer of any unforeseeable lack of stock due to high demand or other reasons.

3 – Methods of payment

The following payment methods are available: PayPal, in compliance with the terms and conditions outlined by the provider of this service.

 

4 – Prices

The published prices are expressed in euros with the indication “+VAT” if the tax is not included and they are those available at the time of order registration. If the value decreases no difference shall be acknowledged on the sum previously paid.
The Taster Study Centre reserves the right to modify the prices at any time.
The delivery expenses are calculated by the system.

 

5 – Acceptance of the General Terms and Conditions

The Customer is expressly required to accept these terms and conditions via electronic confirmation (clicking on the relevant box) when placing the order.
The validation of the order by the Customer nevertheless implies the complete acceptance of the General Terms and Conditions without exception. The Taster Study Centre will send the Customer an email confirming receipt of the order to the email address provided by the Customer.

 

6 – Delivery and lack of conformity

The products shall be delivered to the address indicated by the Customer during the purchasing process, provided that the information was entered accurately and includes all the information necessary to correctly perform the delivery.
The deliveries of physical products shall be carried out by courier. The Taster Study Centre undertakes to carry out the deliveries within 7 days of receipt of the orders, with the exception of holiday periods.
The Taster Study Centre shall not be liable for missing and/or delayed deliveries due to the couriers or to force majeure such as natural disasters, strikes, traffic congestion and particular peak periods.
The Customer acknowledges and accepts that the information on the website relating to availability for the delivery of products is not updated in real time, also in consideration of potential simultaneous website access by several Customers, and therefore the effective availability of individual products may vary.
Pursuant to articles 130 and 130 of Legislative Decree 206/2005, the Taster Study Centre is liable for a period of two years effective from the delivery of the products to the Customer, for any non-conformity of the products found at the time of delivery, particularly as regards products that are faulty or damaged. The Customer shall no longer be entitled to these rights as envisaged in article 130, paragraph 2 of Legislative Decree 206/2005 if no notification of the said defects is supplied to the Taster Study Centre within two months of the date on which the fault was detected.
The Taster Study Centre undertakes to replace, at their expense and within a suitable time period, the delivered damaged and faulty products with other products of the same quality and number available at their warehouses, provided that the items are returned by the Customer in the original packaging (including all relative parts).
If it is not possible to replace it with the same product (for example, due to lack of product availability), the Taster Study Centre shall reimburse the Customer with the amount paid for the faulty product, excluding any further liability of the Taster Study Centre, for any reason.

 

7 – Right to withdrawal and goods returns

This section refers to the contents of the articles from 47, 48 and 64 of Legislative Decree 206/2005 (Consumer code).
Only the Customer Consumer can exercise the right to withdraw from the contract, with the possibility of returning the purchased product and obtaining reimbursement of the entire expense incurred within 10 days of receipt of the product.
The Consumer can exercise the right to withdraw by sending a written letter by recorded delivery with return receipt, telegram, telex, email or telefax to the following address:

Pursuant to article 55, second paragraph of the Consumer Code, the Consumer does not have the right to withdraw in the following cases:

  • supply of sealed audiovisual products or computer software that has been opened by the Customer consumer;
  • supply of products with tailored or customised packaging or that due to their nature cannot be redelivered or that risk rapid deterioration or alteration;
  • supply of newspapers, journals and magazines.

 

Moreover, the right to withdraw cannot be exercised by the Consumer if the product is not intact, i.e.

  • if the original packaging is missing;
  • if parts of the product are missing;
  • due to damage of the product caused by the Customer.

 

The right to withdraw is reserved exclusively for consumers (persons who purchase the goods for purposes other than those linked to their professional, commercial or business activities), and therefore cannot be exercised by legal entities or persons for purposes relating to the professional activity they perform.

The material should be returned within ten (10) days of the delivery of the product at the aforementioned Study Centre site.
The products must be returned suitably protected in their original packaging, in perfect condition for resale (not worn, damaged or soiled by the Customer). The sender is responsible for the costs and risks associated with returning the products.

 

8 – Liabilities

The products comply with the Italian legislation in force.
The photographs and texts are to be considered guideline only and may differ from the product or be modified without notice. As a result, the Taster Study Centre shall not be liable for any errors deriving from these images or illustrative texts.
Moreover, the Taster Study Centre shall not be liable for the breaching of this contract in the event of force majeure.

 

9 – Intellectual Property

All the information shown on the website, all trademarks reproduced on the site, all the programs and / or technologies set out in relation to the site and, more generally, all contents of these websites are reserved and protected. The reproduction of brands and logos in use on the website is strictly forbidden. Moreover, the Customer agrees to not copy, modify, translate reproduce, disclose, sell, publish, enhance and otherwise diffuse in a format other than electronic or means, in full or in part, the information on the website.

 

10 – Obligations of the Customer

The Customer declares and guarantees: (i) to be over the age of eighteen; (ii) that the data provided by the latter for the execution of the Contract is accurate and correct.

 

11 – Privacy

Information on Privacy pursuant to Legislative Decree 196/2003 (“Personal Data Protection Code”). In accordance with the commitment and care that the Taster Study Centre dedicates to the protection of personal data we hereby inform you on the methods, purposes and field of communication and disclosure of your personal data and rights, in compliance with article 13 of Legislative Decree 196/2003. In order to offer you customised services required by our websites, the Taster Study Centre acting as data controller must handle certain identifiable data necessary for the provision of the Service.

 

Browsing data
The software procedures and IT system used for functioning of the websites acquire some data of which the transmission is implicit in the use of internet communication protocols.
This information is not collected for association with identified parties, but due to their nature could allow users to be identified via processing and associations with data held by the data controller or by third parties.
This data category includes IP addresses or domain names of the computer used by the users that connect to the site, the URI (Uniform Resource Identifier) characters of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the data response from the server (successful, error etc.) and other parameters relating to the operating system and the IT environment of the user.
This data can be used by the Data Controller for the sole purpose of retrieving anonymous statistical information on use of the site in order to identify the pages preferred by the users so as to provide increasingly suitable contents and to control correct operation. The data may also be used to check liability in the event of hypothetical computer crimes that damage the website.

The data and cookies received from you shall be handled exclusively by the Taster Study Centre applying the methods and procedures necessary to provide you with the services requested.
The data shall not be distributed but may be disclosed, where necessary for the supply of the service, to the Taster Study Centre’s associations, as well as to the societies that perform tasks of technical or organizational nature that are instrumental to the supply of the required services.
The data may only be used to perform statistical analyses, market surveys and send sales information on the products and promotional initiatives of the Taster Study Centre and/or third-party companies only with your express consent.

Moreover, exclusively on consent, this data may be supplied to other Companies operating in the publishing, financial, car insurance, consumer goods, humanitarian and voluntary organizations who can contact you as data controllers of independent initiatives – the updated list is available to you and can be requested from the Data Controller manager at the address shown below – for statistical analyses, market surveys and sending of sales information on products and promotional initiatives.
Following the registration necessary for the requested Service, where you intend to request/use other Services supplied by the same society or by different societies as indicated above, you may use the credentials (username/email/password) already used for the first registration.
Where necessary, you can request additional data required for the supply of further services requested.
At any time, you may review the information and if necessary, amend the agreements previously supplied, check and/or amend the status of the active services and request any additional services.
The conferment of the data is optional, except for those indicated as compulsory to enable access to the services offered. You are entitled to request information on your data and how they are used at any time. You also have the right to update, integrate, amend or delete these data, request for them to be blocked or object to their handling. We would like to remind you that these rights are set out in Art. 7 of Legislative Decree 196/2003.
The updated list of Data Controllers referred to in this information can be consulted at the registered office of the Taster Study Centre; the exercise of the rights referred to in article 7 of Legislative Decree 196/03 is applicable on specific communication by post addressed to the same Societies.
In accordance with the regulation in force we therefore ask you to grant your consent for the handling of data by ticking the box “Accetto” (“I accept”). It is understood that the agreement refers to the handling of the data with the exception of those strictly necessary for the operations and services requested by you, at the moment of your acceptance in that your agreement is not necessary for these activities.

 

12 – Applicable Laws and Competent Court

This contract is governed by Italian law. This contract is in the Italian language. In the event of disputes, the competent court is that of Brescia, with the exception of controversies with Consumers where the Legal Authority of the place of residence or domicile of the Consumer shall be the competent body.
Pursuant to and for all intents and purposes of the articles 1341 and 1342 of Italian Civil Code, the Customer declares to have viewed, understood and expressly accepted the following clauses: 4 – Prices; 5 – Acceptance of General Terms and Conditions; 6 – Delivery; 7 – Right to withdraw; 8 – Liability; 9 –Intellectual Property; 12 – Applicable Laws and Competent Court.
